An RIA representative is required to register either with the Securities and Exchange Commission (SEC) or state securities administrators and because an RIA representative is regulated directly by the SEC, they are considered to be acting in a fiduciary capacity and held to a higher standard than of conduct than registered representatives.
This fiduciary standard requires that the RIA representative must always act in the client’s best interest, regardless of the circumstances. It is the highest standard of care under the American legal system and is a more stringent rule than what stockbrokers are held to. Stockbrokers are held to the “suitability standard”, which requires them to make specific recommendations based only on their suitability for their clients’ specific circumstances.
